SERVICE CONTRACT

This agreement is between Iconiq Moments (“Provider”) and the individual or entity completing this booking (“Client”). Client represents that they are authorized to enter into this agreement on behalf of themselves and/or the entity for which the booking is made.

  • Service Type: The service selected by Client during the online booking process.

  • Event Date: The event date selected by Client during the online booking process.

  • Photo Booth Start Time: The start time selected by Client during the online booking process.

  • Venue Location: The venue location provided by Client during the online booking process.

  • Add-ons Included: Any add-ons or enhancements selected by Client during the online booking process.

SCOPE OF SERVICES & PROFESSIONAL BOUNDARIES

Iconiq Moments will provide an experience-led, premium photo booth service. One to two trained attendants will be on-site to manage setup, teardown, equipment operation, and guest flow. Iconiq staff are present solely to operate and safeguard equipment and are not responsible for duties outside this scope (e.g., furniture relocation or event coordination). Only services and add-ons explicitly selected during booking are included. Services are provided for the specific continuous hours selected. If the event begins late due to delays caused by the Client, venue, or third parties, services will still conclude at the originally scheduled end time.

FINANCIAL TERMS

The total project cost is the amount displayed at checkout. A non-refundable retainer equal to fifty percent (50%) of the base service rate is due upon submission of the booking form. The remaining balance must be paid in full no later than ten (10) days prior to the event date.

  • Late Payments: If the balance is not paid by ten (10) days prior, a late fee may be assessed.

  • Cancellation: If the balance is not paid by five (5) days prior to the event, the booking will be deemed canceled, the retainer forfeited, and Provider shall have no obligation to perform.

  • Travel: Travel beyond a 30-mile radius of Gastonia, NC is subject to a fee of $1.50 per mile.

  • Approval: All bookings are subject to Provider approval. If not approved, all payments will be refunded in full to the original payment method.

VENUE, TECHNICAL & WEATHER REQUIREMENTS

Client shall provide a level, unobstructed area (minimum 8’ x 8’) with a dedicated power outlet and stable Wi-Fi within twenty (20) feet.

  • Environment: Equipment must be protected from weather. For outdoor events, Client must provide a fully covered, shaded overhead area.

  • Heat/Safety: Provider reserves the right to pause operations if temperatures exceed 90°F or if precipitation or condensation poses a risk to electronic equipment.

  • Connectivity: If Wi-Fi is unstable, media will be queued and delivered post-event. Provider is not liable for delivery delays caused by venue internet.

  • Access: Client must ensure a designated loading zone and guaranteed parking at the venue at Client’s expense.

ARRIVAL & TIMING

Attendants will arrive sixty (60) to ninety (90) minutes prior to the start time for setup. The Service Period begins promptly at the start time selected during booking. If the Client requires the booth to be set up earlier than the service start time (e.g., to avoid disruption during a ceremony), these additional hours must be booked as part of the total service duration at the standard hourly rate. Provider does not offer unpaid or discounted idle time.

CANCELLATION & RESCHEDULING

All payments are final and non-refundable once the ten (10) day payment deadline has passed. To reschedule, the original retainer is forfeited and a new retainer is required. In the event Provider is unable to perform due to circumstances beyond control (Acts of God), the Client may reschedule within one hundred eighty (180) days at no additional cost. If Provider is unable to perform due to unforeseen mechanical failure or illness, Provider’s liability is limited to a full refund of all monies paid by Client, which shall constitute Client’s sole and exclusive remedy.

LIABILITY, SAFETY & DAMAGE

Client assumes full financial responsibility for any damage to Iconiq Moments equipment caused by guests, attendees, or third parties during the event. Any required repairs or full replacements (at standard vendor pricing) will be invoiced to the Client.

  • Supervision: Children under the age of twelve (12) must be supervised by an adult at all times when near the equipment.

  • Conduct: Provider maintains a zero-tolerance policy for hostile or unsafe behavior and reserves the right to cease services immediately if staff or equipment are at risk.

  • Finality: Once services are rendered, all sales are final. No refunds, chargebacks, or payment reversals will be permitted.

MEDIA RIGHTS & PRIVACY

Iconiq Moments retains the right to use media captured during the event for marketing and promotional purposes. Guests will be presented with a digital Model Release / Terms of Use on the booth interface prior to receiving their media. If the Client requires a full non-disclosure agreement (NDA) for the entire event, a Privacy Fee equal to ten percent (10%) of the total project cost will apply and must be requested prior to the event.

ACKNOWLEDGMENT & ACCEPTANCE

By providing an electronic signature and submitting this booking, Client acknowledges they have read, understand, and agree to these terms and confirm all booking selections are accurate and binding.
